2. The petitioners are apprehending their arrest in Mahnar P.S. Case No. 185 of 2023 registered under Sections 341, 323, 324, 307, 354, 379/34 of the Indian Penal Code.
3. Allegedly, the occurrence took place on a trivial issue. It is alleged that the accused persons assaulted the informant's brother as a result of which, he sustained head injury. On alarm, when the family members of the informant intervened to rescue, they were also assaulted.
4. It has been submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.36559 of 2024(4) dt.20-09-2024 2/2 petitioners are the persons of clean antecedent. There is case and counter case between the parties. Both the parties have suffered injuries and the allegations are general and omnibus.
5. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
6. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 185 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
7. It is made clear that the petitioners will appear in the court below on each and every date fixed in the case till framing of charge.
