2. Petitioner seeks regular bail in connection with Tajpur (Waini O.P.) P. S. Case No. 361/2023 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

3. Prosecution case, in brief, is that on 77.76 liters illicit liquor has been recovered from a vehicle.

4. Learned counsel for the petitioner submits that petitioner has been made accused in this case only on the basis of confessional statement of co-accused Pappu Kumar. It is next submitted that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is in custody

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise) Court No.2, Samastipur in connection with Tajpur (Waini O.P.) P. S. Case No. 361 of 2023.
