JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. There is specific allegation against the petitioner that he got executed forged power of attorney.

Learned counsel appearing for the petitioner submits that as a matter of fact, petitioner had given some amount to informant and thereafter, informant executed power of attorney but subsequently, he changed his stand and lodged this false case.

Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with

Patna High Court CR. MISC. No.30680 of 2019(3) dt.16-11-2019 2/2 Civil Line P.S. Case No. 41 of 2018, stands rejected. However, if petitioner surrenders before the concerned court within six weeks from today and seeks regular bail, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this order.
