JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-02-2024 The present writ petition has been filed seeking the following reliefs:- "a. To issue a writ of mandamus commanding and directing the respondents to consider the cases of this petitioner for granting him the benefits of the Assured Career Progression Scheme, 2003 and grant the petitioner 1st Assured Career Progression Scheme benefits with effect from 9th August 1999 (the date of implementation of the scheme as before this date itself, the petitioner completed twelve years of service) and 2nd Assured Career Progression Scheme benefits with effect from

Patna High Court CWJC No.8523 of 2022(2) dt.13-02-2024 2/2 20th April 2000 (upon completion of 24 years of service) which has been unnecessarily withheld despite the fact that the petitioner had superannuated from services on 31 July 2007 from the post of Mohirir/Lower Division Clerk from the office of the respondent No. 4. b. To direct the respondents to pay the arrears thereof expeditiously along with interest.

c. To accordingly refix the pay and allowances and refix the pensionary and other pensionary benefits accordingly."

At the outset, the learned counsel for the petitioner seeks not to press the writ petition, however, seeks liberty on behalf of the petitioner to approach the respondent-authorities for redressal of his aforesaid grievance. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
