The petitioner seeks bail in connection with Riga P.S. Case No. 322 of 2024 instituted for the offence under Sections 109 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

As per prosecution case, petitioner alleged fired upon the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.03.2026. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's

Patna High Court CR. MISC. No.30738 of 2026(3) dt.21-07-2026 2/2 counsel that petitioner has been falsely implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. It is submission of the petitioner's counsel that informant sustained injury on his left hand and the same was found to be simple in nature.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner by contending that there is direct allegation of firing against the petitioner.

Considering the aforesaid facts and circumstances of the case, there being direct allegation of firing against the petitioner as also petitioner bears one criminal antecedent, this Court, at this stage, is not inclined to grant bail to the petitioner. Prayer for grant of bail to the petitioner is hereby rejected. 8.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.
