JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-10-2020 Heard Mr. Rajnish Chandra, learned counsel for the petitioners and Md. Aslam Ansari, learned APP for the State. The petitioners, who are the husband and wife among themselves, seek bail in anticipation of their arrest in connection with Theterhat P.S. Case No. 02 of 2020, dated 08.01.2020, instituted for the offences under Sections 366(A), 504 and 506/34 of the Indian Penal Code.

No.25665 of 2020(2) dt.14-10-2020 2/3 The son of the petitioners, viz., Rishdeo Manjhi is said to have eloped with the daughter of the informant, viz., Sabo Kumari, who is the neighbour of the petitioners. Learned counsel for the petitioners submits, according to the information received by him, that the victim has been recovered, who claims to have run away with the son of the petitioners of her own volition. The petitioners have only accepted the marriage of their son with the daughter of the informant. Beyond that, no specific overt act has been attributed against the petitioners.
Considering the relationship of the petitioners with the main accused and the fact that the girl has been recovered, they, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Thatarhat P.S. Case No. 02 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
