The petitioner apprehends his arrest in Hajipur Town P.S. case No. 165 of 2019 registered under Section 414 of the IPC and u/s 11(A) of Prevention of Cruelty to Animals Act. The informant intercepted a truck bearing registration No. BR01GG- 9586 and seized 21 she-buffaloes loaded on the truck. The driver of the vehicle was apprehended who disclosed his name as Aftab but the driver of the truck did not produce any paper with regard to the animals.
The learned counsel for the petitioner submits that petitioner is owner of the truck. The driver of the truck was plying the vehicle on hire. Md. Tahid purchased the shebuffaloes and he hired the truck for their transporation. Considering the facts aforesaid and nature of

No.29063 of 2019(2) dt.02-05-2019 2/2 allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. case No. 165 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
