2. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 135 of the Electricity Act.

3. It is alleged that the petitioner committed power theft and caused loss of revenue of Rs.3,09,564/-.

4. Learned counsel for the petitioner submits that the petitioner is ready to return the total loss amount in instalments, subject to result of the case.

5. Considering the submission of learned counsel for the petitioner, in the event of arrest/ surrender within a period of six weeks from today, let the petitioner, named above, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Electricity Court, Magadh Division, Gaya in Paras Bigha Police Station Case No. 253 of 2023, subject to conditions laid down u/s 438(2) of the

Patna High Court CR. MISC. No.36804 of 2024(3) dt.24-07-2024 2/2 Cr. P. C., as well as on the following conditions:- (i) At the time of furnishing bail bond Rs. 1,60,000/- (one lac and sixty thousand) shall be deposited in the office of the Electrical Executive Engineer, Electric Supply Sub Division, Jehanabad and a receipt to this effect shall be filed by the petitioner in the court below.

(ii) Rest amount shall be deposited in two equal installments in six months thereafter.
