The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 324, 379, 427, 326, 354, 504 and 506/34 of the Indian Penal Code.
Allegation against the petitioner is that he assaulted the informant's father with Farsa which caused bleeding injury on his hand.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The alleged occurrence is said to have taken place due to previous enmity. So far offence u/S 379 of the Indian Penal Code, the same is superficial in nature. The injury is said to be on non-vital of the body. There is no injury
Patna High Court Cr.Misc. No.52665 of 2018 (2) dt.11-09-2018 report to indicate whether the injury was simple or grievous. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 87 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
