The petitioners apprehend their arrest in connection with Complaint Case No. 1725C of 2011 registered under Sections 148, 323, 341, 386 and 504 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that this is a complaint case. Petitioner no.1 is Ward Commissioner and petitioner no. 2 is Jamadar of the Municipal Corporation. They are innocent and have falsely been implicated in the present case. Further submission is that on perusal of Annexure-5, it appears that the Title Suit No. 18 of 2008 is pending between the parties, which was earlier filed by
Patna High Court CR. MISC. No.30211 of 2020(2) dt.01-03-2021 2/2 the complainant. Further submission is that petitioners have no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Begusarai in connection with Begusarai Complaint Case No. 1725 (c) of 2011, subject to the condition as laid down under Section 438(2) of the Cr.
