The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act (Amended) 2018. It is a case of recovery of 240 liters of country made wine from a car bearing Registration no.WB-02X-8726, which belong to this petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is ready to deposit Rs.30,000/- in favour of the District Legal Services Authority, Aurangabad, (Bihar). Petitioner has clean antecedent.

Patna High Court CR. MISC. No.30978 of 2022(3) dt.13-12-2022 2/2 Learned APP appearing for the State opposed the anticipatory bail and submitted that the petitioner is a registered owner of the vehicle in question, seized on the spot. Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special JudgeExcise-I, Aurangabad (Bihar) in connection with Town P.S. Case No. 407 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C with further condition that at the time of furnishing bail bond, the petitioner shall produce receipt of Rs.30,000/ meant to be paid to District Legal Services Authority, Aurangabad (Bihar).
