JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-02-2015 Petitioner is languishing in custody since 16.06.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 307, 353 of the I.P.C and Section 27 of the Arms Act.

On confidential information to the effect that Md. Jamal Mian and his associates assembled to commit dacoity in the house of Amrendra Kumar Swarnkar the police raided the place when the accused persons resorted to firing. The name of the petitioner appeared in the confessional statement of Md. Jamal Mian.

It is submitted by learned counsel for the petitioner that nothing has been recovered from the petitioner nor the petitioner has been put on test identification parade and similarly situated accused Kari Mian @ Kari Mian @ Razzaque has been granted bail vide Cr. Misc. No. 34874 of

Patna High Court Cr.Misc. No.4230 of 2015 (2) dt.06-02-2015 2/2 2014.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnia in connection with Bankankhi P.S. Case No. 55 of 2011.

Since the petitioner has criminal antecedent, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial. (Dinesh Kumar Singh, J) Shageer/- U T
