JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-09-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

Learned counsel for the petitioners has submitted that the case has been compromised and as per settlement arrived amongst the parties, petitioners have to pay the amount in installment and on the basis thereof, petitioner no.2, namely, Gautam Azad Govinda who was arrested, was granted bail by the learned lower court itself vide order dated 04.09.2018. Learned counsel for the complainant accepted the same. The aforesaid submission has been made under supplementary affidavit. So, it has been submitted that petitioner no.1 who happens to be wife of petitioner no.2 seeks withdrawal of instant petition in order to get same privilege by the learned lower court. In terms thereof, instant petition is dismissed as withdrawn with regard to petitioner no.1.

Patna High Court Cr.Misc. No.53821 of 2018 (2) dt.12-09-2018 So far petitioner no.2 is concerned on account of his arrest, this petition has become infructuous and is accordingly dismissed.
