JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-02-2021 The petitioner has filed the present writ petition seeking direction upon the respondent- authorities to accept his joining at Prathmik Vidyalaya Pandepur, Block- Simri, District Buxar, inasmuch as he is stated to have submitted his joining at the said school on 13.07.2020, after recovering from his illness, however, his joining is not being accepted.

This Court finds that the present writ petition is not maintainable inasmuch as the remedy of the petitioner lies before the District Appellate Authority, Buxar. In such view of the matter, the learned counsel for the

Patna High Court CWJC No.7959 of 2020(2) dt.20-02-2021 2/2 petitioner seeks liberty to approach the aforesaid Authority by filing appropriate complaint.

Accordingly, the present writ petitioner stands disposed of as not pressed, however, with liberty to the petitioner to approach the District Appellate Authority, Buxar and in case, any petition is filed by the petitioner within a period of two weeks from today, the same shall be considered and disposed of in accordance with law within a period of three months thereafter, after due notice to all the effected/ concerned parties.
