The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 24/2019, instituted for offences under Section(s) 341, 323, 308, 354 and 436/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that there is case and counter case between the parties. Instant case has been filed just to save the skin. Brother of petitioner has lodged Complaint Case No. 58(c)/2019 against informant and his associates under Section 147, 148, 149, 341, 379, 323 of the Indian Penal Code read with Section 27 of Arms Act, in which petitioner is one of the witness.
It is alleged in the written report that on the date of occurrence this petitioner along with other accused persons
Patna High Court CR. MISC. No.32579 of 2019(2) dt.16-05-2019 2/2 surrounded the informant while he was going towards four lane. They assaulted the informant. Anyhow informant moved towards his house then petitioner along with Sudhir Yadav entered into his house. Sister-in-law of informant came to save him then the petitioner and co-accused Sudhir Yadav assaulted her with rod and also tried to outrage her modesty. The accused persons set the house of informant on fire and fled away. Petitioner is in custody since 18.01.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Barh, Patna, in connection with Bakhtiyarpur P.S. Case No. 24/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
