2. The petitioner apprehends arrest in connection with Pothia P.S. Case No. 164 of 2024 dated 12.07.2024, registered for the offence punishable under Sections 126(2), 115(2), 117(2), 76, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The specific allegation against the petitioner is that he assaulted with iron rod on the person of the father of the informant due to which he sustained injury on his head.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that the present case is counter blast of S.C./S.T., Kishanganj P.S. Case No. 15 of 2024 dated 10.07.2024 and the present case has been lodged on 12.07.2024 for the occurrence dated 04.07.2024. It is submitted that Kishanganj P.S. Case No. 15 of 2024 has been lodged by the petitioner against the father of the informant. Both the sides are resident of the same

It is further submitted that during pendency of this case, the compromise petition has been filed on 13.03.2026, wherein, both the parties have stated that they have settled their dispute outside the court and the said compromise petition has been filed before A.C.J.M.-II, Kishangaj. Lastly, it has been submitted that the petitioner has no criminal antecedent.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Pothia P.S. Case No. 164 of 2024, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Kishanganj, subject to condition as laid down under Section 482(2) of B.N.S.S..
