The petitioner seeks bail in Chapra Town P.S. Case No. 750/2018, instituted for offence under Section(s) 307/34 of the Indian Penal Code read with Section 27 of Arms Act. Later on Section 302 of the Indian Penal Code was also added. It is alleged in the written report that while informant was sitting in his house, this petitioner and one Bhushan Rai came on motorcycle. It is alleged that Bhushan Rai made firing on the waist of informant on account of which he fell down. Thereafter he was brought to hospital in injured condition and subsequently died.
Learned counsel for the petitioner has submitted that there is no allegation of overt act against this petitioner in the
Patna High Court CR. MISC. No.30383 of 2019(4) dt.02-08-2019 2/2 written report.
Petitioner is in custody since 29.12.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S. Case No. 750/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
