JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2018 In the present case there is dispute as to inter se seniority in appointment of Incharge Headmaster. There is no post of Incharge Headmaster. It is only by way of interim arrangement. The petitioner, who happens to be a Panchayat Shikshak, is not entitled to be appointed as Incharge Headmaster as a matter of course.
The dispute of inter se seniority and appointment of Incharge Headmaster was raised in the year 2012. We are in 2018. The Court has reason to believe that with the passage of time either regular Headmaster is posted or the dispute must have come to an end.
Patna High Court CWJC No.11203 of 2012(3) dt.06-07-2018 2/2 In case the dispute is not resolved as yet, the District Programme Officer, Establishment is directed to take final decision as to inter se seniority of the petitioner and respondent No. 4 and at the same time he shall also see that regular Headmaster is posted in the school in question to avoid the dispute as to appointment of Incharge Headmaster. The entire exercise in this regard must be completed within a period of three months from the date of receipt/production of a copy of this order.
With the aforesaid, the writ petition stands disposed of.
