2. The petitioner seeks bail in a case registered for offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 32.055 liters of illicit foreign liquor has been recovered from the hut of the petitioner.

4. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner, rather the same has been recovered from the hut, which is in joint possession of the family. Petitioner has got no concern with the alleged recovery and he is in custody since 09.04.2024.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Samstipur in connection with Excise P.S. Case No. 247 of 2021.
