The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and u/s 30 (a) & 37 (c) of Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners submit that there is no recovery from the conscious possession of the petitioners and petitioners are not involved in any another case (Excise Act). Petitioner no. 1 has one criminal case is pending in Muzaffarpur Town P.S. Case No. 253 of 2006 for the offences u/s 364 (A)/34 of the Indian Penal Code in which he is on bail and petitioner
Patna High Court CR. MISC. No. 28923 of 2019(3) dt.24-07-2019 2/2 no. 2 is concerned there is no criminal antecedent. In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Motipur P.S. Case No. 1036 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
