10-09-2018 Two petitioners, apprehending their arrest in Complaint Case No. 1384(C) of 2008 registered for offence under Sections 420, 409, 467, 471 and 120B of the Indian Penal Code, have prayed for grant of anticipatory bail, primarily on the ground that one of the main accused in the complaint case namely Jagdish Prasad has already been extended the privilege of anticipatory bail by the court below itself. I have also perused the complaint petition. Fact remains that complaint case was filed in the year 2008 itself and in that case, inquiry continued for a long period and after several years, cognizance order was passed. Moreover, since accused no. 1 (i.e. Jagdish Prasad) of the complaint petition has already

Patna High Court Cr.Misc. No.53792 of 2018(2) dt.10-09-2018 2/2 been extended the privilege of anticipatory bail by the court below itself, there is no reason to refuse the same prayer of both the petitioners.

Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let aforesaid two petitioners namely Sangita Devi and Dhananjay Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Bihar Sharif in connection with Complaint Case No. 1384(C) of 2008, Subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
