JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-12-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel appearing for the petitioners and Shri Mukteshwar Deyal, learned A.P.P. for the State.

The present petition has been filed for modification of the order dated 03.03.2020 passed in Criminal Misc. No. 10023 of 2020 to the extent that the period granted to the petitioners for surrendering before the learned court below for the purposes of obtaining the privilege of anticipatory bail, be

Patna High Court CR. MISC. No.32325 of 2020(2) dt.23-12-2020 2/2 extended by a further period of six weeks from today. The learned counsel for the petitioners has submitted that on account of the pandemic situation due to COVID-19, the petitioners could not surrender before the learned court below within the stipulated time frame, hence the time granted to surrender, may be extended. Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioners and taking into account the averments made in the present petition, I deem it fit and proper to extend the time period granted to the petitioners to surrender before the learned court of Chief Judicial Magistrate, Motihari, East Champaran at Motihari in connection with Piprakothi P.S. Case No. 320 of 2019, for the purposes of availing the privilege of anticipatory bail, by a further period of four weeks from today.

Accordingly, the order dated 03.03.2020 passed in Criminal Misc. No. 10023 of 2020 stands modified. The petition stands allowed.
