The petitioner apprehends arrest in a case registered for the offence punishable under sections 406/409 of the Indian Penal Code.

As per FIR, petitioner along with others misappropriated the Government money allotted under Nal Jal Scheme and did not complete the work.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, during investigation it has come excess work to the tune of Rs. 14.97 lakhs has been done, though the work was completed after institution of FIR. Petitioner is a lady having no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender

Patna High Court CR. MISC. No.31146 of 2022(2) dt.10-10-2022 2/2 within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Bikramganj, Rohtas at Sasaram in Dinara Police Station Case No. 146 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
