Heard the learned counsel for the petitioner as well as the learned APP for the State.

This application has been filed for modification of the order dated 08.12.2021 passed in Criminal Miscellaneous No. 54217 of 2021.

Vide order dated 08.12.2021, the petitioner was granted anticipatory bail in Criminal Miscellaneous No. 54217 of 2021. The learned court below was directed that it shall notice both the parties for amicable settlement and if the

Patna High Court CR. MISC. No.31897 of 2022(5) dt.12-10-2022 2/2 petitioner would be found cooperative, the learned court below shall confirm the provisional bail of the petitioner. The order shows itself that the court below was directed to confirm the provisional bail of the petitioner if the petitioner would be found co-operative.

Instead of filing application for confirmation of the bail bond before the court below, the petitioner has filed the present modification petition before this Court for confirmation of the bail bond.

The petitioner is directed to appear before the court below and make a prayer for confirmation of the bail bond in the light of earlier order dated 08.12.2021.

With these observations/directions, this criminal miscellaneous application is being disposed of. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
