Petitioner apprehends his arrest in Bihta P.S. Case No.1124 of 2018, registered under Section 307 and other Sections of the Indian Penal Code.

The informant, Satish Giri named the petitioner and alleged that the petitioner along with other accused persons came near the site of construction and began to abuse the informant. They entered into the house of the informant. Petitioner, Jyoti Yavad is alleged to have assaulted the informant with iron rod on his head.

Learned counsel for the petitioner submits that prior to institution of the present FIR, Bihta P.S. Case No. 1122 of 2018 is registered on the basis of fardbeyan of Rabindra Kumar,

Patna High Court CR. MISC. No.30634 of 2019(2) dt.09-05-2019 2/2 the maternal uncle of the petitioner. The land of Rabindra Kumar is situated by the side of the informant and some verbal altercation took place due to passage. It is submitted that the injury found on the head of Satish Giri is superficial and simple in nature.

Taking into consideration the fact that there appears land dispute between two sides on account of passage and Rabindra Kumar, the maternal uncle of the petitioner happens to be the neighbour of the informant, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Danapur(Patna) in connection with Bihta P.S. Case No.1124 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
