2. The petitioner seeks regular bail in connection with Katihar Town P.S. Case No. 837 of 2023, registered for the offence under Sections 302, 120/34 of the Indian Penal Code and sections 27, 25(1-B)a, 26, 35 of the Arms Act.

3. From the F.I.R., it is alleged that the petitioner is the brother of the deceased. During investigation, the petitioner participated in the conspiracy to killing the deceased due to land dispute.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. The petitioner is not named in the F.I.R. The name of the petitioner transpired on the basis of confessional statement of co-accused

Patna High Court CR. MISC. No.34679 of 2024(3) dt.27-09-2024 2/2 person. The petitioner has clean antecedent and he is custody since 23.11.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the role of the petitioner in the crime, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application for regular bail is dismissed.
