1. The writ petition has been filed seeking relief to direct the respondents to make payment of the admissible dues to the petitioner accrued due to hiring of the vehicle (Tavera) @ of Rs. 15,000/- per month since 29.03.2011 by the respondents no. 4 and 5, which is amounting to Rs. 4,95,000/- till 30.11.2013 and also to pay against the hiring for the said vehicle for further period.

The brief facts of the case are that respondents no. 4 and 5 have hired the vehicle of the petitioner i.e. Tavera vehicle bearing No. BR-21C-4744 for the amount of Rs. 15,000/- per month and also executed an agreement for a period of two years. Inspite of the satisfactory performance of the vehicle, the 4th and

Patna High Court CWJC No.10724 of 2016(7) dt.16-07-2024 2/2 5th respondents have not paid the hired amount for which the petitioner made representations along with the reference of the logbook. As the writ petitioner did not receive any payment, the present writ application has been filed for the non-payment of the hired amount.

3. A detailed counter affidavit has been filed by the respondent no. 4 and 5. The counter affidavit disclose that after receiving the representations of the petitioner his claim was considered and the same was communicated to the petitioner to submit his bank account number and accordingly, the admissible amount of Rs. 3,70,960/- was deposited in the account of the petitioner.

4. Heard learned counsel for the petitioner as well as learned counsel for the respondent. As the admitted dues of the petitioner have been paid by the 4th and 5th respondent no further order is necessary in this case.

5. Therefore, the present writ application stands disposed of.
