2. The petitioner has prayed for bail in connection with Nautan P.S. Case No. 263 of 2024 registered for the offence punishable under Sections 317(5) and 61(2) of B.N.S. ans Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. The case of the prosecution is that from the possession of this petitioner, one loaded country made pistol and six live cartridges were recovered. It is further alleged that there is allegation that the petitioner along with others have looted the jewellery shop, namely, Maa Lakshmi Jewellers on gun point.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.31251 of 2025(2) dt.21-05-2025 2/2 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. No incriminating article has been recovered from his possession except the loaded country made pistol and six live cartridges. It has also been submitted that similarly situated coaccused has been granted anticipatory bail by the trial court itself. Petitioner is languishing in judicial custody since 23.10.2024.

5. The learned APP for the State has vehemently opposed the application for bail and submitted that petitioner is having criminal antecedent of two cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-8, Siwan in connection with Nautan P.S. Case No. 263 of 2024.
