The petitioner is in custody in connection with Vaishali (Belsar O.P.) P.S. Case No. 91 of 2019 for the offence under Sections 399, 401, 402 of the Indian Penal Code and Sections 25(1-b), 26 and 35 of the Arms Act.

Referring to the prosecution case, learned counsel for the petitioner submits that from the possession of the petitioner only one Samsung Mobile was recovered and as such the provisions of Arms Act is not attracted. He further submits that the petitioner has got no criminal antecedent and he is in custody since 09.03.2019.

Considering the totality of the facts and circumstanced discussed above, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of

Patna High Court CR. MISC. No.28575 of 2019(2) dt.30-04-2019 2/2 Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (Belsar O.P.) P.S. Case No. 91 of 2019.
