====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-08-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under section 316(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, informant gave Rs. 4,01,700/- to the petitioner for supply of labourer to his brick kiln, but petitioner neither supplied labourer to the informant's brick kiln nor did he return the aforesaid money to the informant.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. as a matter of fact, petitioner has no dues of the informant, rather informant has not paid wages to the labourers, provided by the petitioner to the brick kiln of informant and to put pressure, informant has lodged this case

Patna High Court CR. MISC. No.41429 of 2025(3) dt.21-08-2025 2/2 against the petitioner with false allegations. No cheat of paper has been produced by the informant in support of his claim.

5. Considering the nature of dispute, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XIII, Gaya in Khizersarai Police Station Case No. 361 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
