JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-08-2018 Heard learned counsel for the petitioner and learned counsel representing the State. Despite service of notice, nobody has appeared on behalf of the respondent nos.7 and 8. While learned counsel for the State has placed reliance on Annexure-C to the supplementary counter affidavit showing that the Deputy Superintendent of Police, Muzaffarpur has written to the Senior Superintendent of Police, Muzaffarpur vide his letter dated 29.07.2018 that adequate police force would be made available as and when required on the requisition of the

Patna High Court Cr. WJC No.2643 of 2017 (5) dt.08-08-2018 Anchaladhikari, Mushahari, Muzaffarpur, but in course of enquiry conducted by the Deputy Superintendent of Police nobody was present, learned counsel for the petitioner has a submission that the petitioner was never informed with regard to the enquiry to be held by the Deputy Superintendent of Police and, therefore, in absence of any information he had no occasion to be present when the Deputy Superintendent of Police reached at the spot. In the aforesaid view of the matter, this Court would direct that on the petitioner visiting the office of the Deputy Superintendent of Police, Muzaffarpur on Monday i.e. 13.08.2018, the Deputy Superintendent of Police, Muzaffarpur shall consider the grievance of the petitioner in the light of the decision rendered in Case No.M-1136/13 and other relevant materials and shall take appropriate steps to implement the said order in accordance with law.

The writ application stands disposed of with the aforesaid direction.
