Heard both parties.
The petitioner seeks bail in Chainpur P.S. Case No. 314 of 2018 GR. No. 2799/18, registered for the offence punishable under Sections 304(B), 120(B) and 34 of the Indian Penal Code.
As per the prosecution case, informant's daughter was married with the petitioner in the month of May, 2018. It is further alleged that this petitioner along with other accused persons started demanding dowry in the form of motorcycle and due to non-fulfillment of the same, they set on fire the daughter of informant after sprinkling kerosene oil, as a result of which

It is submitted on behalf of the petitioner that petitioner happens to be husband of deceased and has committed no offence as alleged in the FIR. Informant's daughter (deceased) committed suicide. Moreover, other coaccused have been granted bail by this court. Petitioner is in custody since 23.01.2019 having no criminal antecedent as stated in para 3 of the bail petition.
Learned APP however, vehemently opposed the bail application and submitted that there is specific allegation of demand of dowry against this petitioner and deceased died within seven years of her marriage at her Sasural. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
