2. The petitioner is apprehending arrest in connection with Dhaka P.S. Case No. 28 of 2024, dated 21.01.2025, lodged under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution, total recovery of 32.7 litres of illicit wine has been made, which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel for the petitioner submits that nothing has been recovered from conscious possession of the petitioner. Further submitted that the recovery of the wine has been made behind the back of his shop which is not in his possession.

5. Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.30718 of 2025(2) dt.15-05-2025 2/2 anticipatory bail of the petitioner submitting that the petitioner has got one criminal antecedent of similar nature.

6. In the present facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.

7. However, in case the petitioner surrenders within six weeks from today, the learned Trial Court will consider his application for regular bail on its own merit preferably on the same day without being prejudiced by the order of this Court. (Dr. Anshuman, J) perwez U T
