JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-11-2020 Heard Mr. Kalyan Shankar, learned counsel for the petitioner and Mr. Binod Kumar No. III, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Lalganj P.S. Case No. 350 of 2018 registered for the offence under Sections 363, 364, 302, 201, 120 B / 34 of the I.P.C. The allegation as per the First Information Report is that one Mithun Sahani arrived at the house of the informant and called his younger brother- Sumit Kumar, who accompanied the said Mithun Sahani, but the brother of the informant did not return back to his home.
It has further been alleged that subsequently the said Mithun Sahni was arrested in another case and in his confessional statement he has disclosed that the brother of the informant has been killed by the petitioner and other accused persons and further that he had given the contract for killing of informant's brother to one Arun Rai.

Learned counsel further submits that similarly situated co-accused Vijay Rai has been granted bail by this Court in Cr. Misc. No. 26296 of 2019. Learned counsel also submits that petitioner is in custody since 13.01.2020 i.e. for more than 09 months.
Having heard learned counsel for the parties and taking into consideration the materials available on record and the fact that similarly situated accused has been granted bail by this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur / court concerned in connection with Lalganj P.S. Case No. 350 of 2018.
It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
