The petitioner is in custody in connection with Keshariya P.S. Case No. 116 of 2019 for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a), 41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 06.04.2019. He further submits that on search of place of Bhulwan @ Shahsi Rai and Ram Babu Rai, a red colour plastic gallon containing 50 liter country made liquor, weighing machine, the vessel for preparing country made liquor, Head of Handpump, Jaggery (Mitha)-10 quintals, 22 packet of Nausadar (25 kg.), half built the mixture of Jaggery and Nausadar in 12

Patna High Court CR. MISC. No.30452 of 2019(2) dt.07-05-2019 2/2 Drum were recovered. He further submits that place of recovery does not belong to the petitioner and there is no recovery from the house of the petitioner.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned 7th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran, Motihari in connection with Keshariya P.S. Case No. 116 of 2019.
