2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 303, 111(2)(b), 111(3), 111(4), 111(5), 112(2) of Bhartiya Nyaya Sanhita, 2023, Section 21 of MM (D&R) Act, 1957 and Rule 56 of BM (CPIMTS) Rules, 2024 .

3 . The prosecution case in brief, is that this petitioner along with other co-accused persons are alleged to be indulged in illegal mining and storage of sand.

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged . Petitioner has been made accused only on the basis of

No incriminating article has been recovered from possession of petitioner and has got no concern with the alleged recovery . Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Gaya in connection with Fatehpur P.S. Case No. 683 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
