Learned counsel appearing on behalf of the respondents states that the present writ petition is not maintainable as the petitioner has an alternative and efficacious remedy of filing an appeal under Section 16 of the Bihar and Orissa Public Demand Recovery Act, 1914, before the concerned authorities.
3. Learned counsel for the petitioner though has tried to argue on merits of the case, this Court is not inclined to entertain the present writ petition as the petitioner is having alternative and efficacious remedy of filing an appeal under the Act.
4. Having regard to the above the writ petition is
Patna High Court CWJC No.8189 of 2016(11) dt.11-12-2023 2/2 disposed off with a direction to the petitioner to avail the remedy of filing an appeal under Section 16 of the Act before the appropriate authority within a period of four weeks from the date of receipt of a copy of this order and on filing of the said appeal, the authority concerned shall disposed of the same in accordance with law.
5. With the above directions, the present writ petition stands disposed off.
