JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner is apprehending his arrest in a case for the offence registered under Sections 304(B) and 201/34 of the IPC.
The prosecution story, in brief, is that the Sweta Rani daughter of the informant was married with co-accused Rohit Kumar on 04.05.2017. It is alleged that due to non-fulfilment of demand of dowry, accused persons killed the daughter of the informant and her dead body has been disposed of by the accused persons with the help of the petitioner Raja @ Raja Kumar (driver).
Patna High Court Cr.Misc. No.52860 of 2018 (2) dt.20-09-2018 2/2 It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused in the present case due to mistake of fact. The petitioner is a co-villager. He is not related with the family members of the husband of the deceased. He had no concern with the alleged occurrence. On behalf of the learned counsels for the State and the informant, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist, Khagaria, in connection with Parbatta P.S. Case No. 67/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
