====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-01-2021 Heard the parties.

The petitioner is languishing in custody for the offence punishable under Sections 341, 323, 451, 324, 307 and 504/34 of the Indian Penal Code.

Petitioner is in custody since 19.03.2020.

Allegation is that the petitioner and others assaulted to the informant and her daughter. The doctor has found incised wounds on non-vital part of the body of the informant, which are simple in nature and similar observation is in the matter of injury nos. 2 and 3 found on the daughter of the informant. Opinion regarding one of the injuries found on the daughter of the informant is awaited. Investigation of the case is already complete.

Considering the nature of allegation and period

Patna High Court CR. MISC. No.29534 of 2020(3) dt.18-01-2021 2/2 already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chakiya P.S. Case No. 78 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
