====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner, the State and the informant.

The petitioner seeks regular bail registered for the offences punishable under sections 302/34 of the Indian Penal Code.

As per the prosecution case, all the FIR named accused persons including the petitioner took away the informant's father from his house and killed him and dropped the dead body on his doors.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. From perusal of the FIR, it appears that no one including the informant himself has seen the occurrence and at best it is the case of last seen with the deceased. Petitioner has got clean

Patna High Court CR. MISC. No.40748 of 2021(3) dt.22-11-2021 2/2 antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 17.3.2021.

Learned counsel for the State and informant oppose the prayer for bail and submit that the there is specific allegation that all the FIR named accused persons including the petitioner took away the informant's father from his house and killed him and left the dead body on his doors. Post mortem report also reveals that the cause of death seem to be hemorrhaagic and neurogenic shock as a result of injuries.

Considering the nature of accusation and the materials collected during course of investigation against the petitioner, his prayer for bail is refused.
