====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 30-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 363, 365, 366A and 34 of the Indian Penal Code. The victim and her mother, in compliance of the order dated 21.11.2022, has been produced by Sub-Inspector Binay Kumar of Raniganj P.S.
The victim who appears to be a major and claims to be a major also has submitted that her statement under Section 164 CrPC was recorded before the learned Trial Court in which she has not supported the prosecution case and she has married the petitioner and is now pregnant and is expecting to deliver the child soon.
Patna High Court CR. MISC. No.30530 of 2022(3) dt.30-11-2022 2/2 Learned A.P.P. for the State also after perusing the case diary submits that the victim in her statement recorded under Section 164 CrPC has disclosed her age as 19 years and has not supported the case of the prosecution.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Raniganj P.S. Case No. 203 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) HarshPandey/- U T
