====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 23-07-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Raniganj P.S. Case No.207 of 2024 instituted under Sections 363, 366A/34 of the Indian Penal Code.

3. As per the prosecution case, the minor daughter of the informant had been kidnapped by co-accused Md. Abub and Md. Mofij and when the informant side went to ask in this regard from the family member of the accused Md. Abub, the petitioners who are parents of the accused Md. Abub misbehaved with them.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.30203 of 2025(3) dt.23-07-2025 2/3 petitioners are innocent and have been falsely implicated in this case due to village politics. He further submits that there is no allegation against the petitioners for kidnapping the daughter of the informant. Learned counsel submits that petitioners are old persons aged about 80 and 75 years respectively having no concern with the occurrence. He further submits that the victim in her statement recorded under Section 183 of BNSS has not made any allegation against the petitioners rather she has stated that she left her house with the co-accused Md. Abub. Learned counsel submits that petitioners have got clean and fair antecedent and they undertake to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned A.C.J.M.-I, Araria in connection with Raniganj P.S. Case No.207 of 2024, subject to the conditions laid down in
