The writ petition has been filed for the following reliefs :- "For issuance of an appropriate writ/direction commanding the respondents to make payment of petitioner's salary from May 1999 to 11.4.2010 further grant 12% interest per annum on aforesaid dues and count increment of this period. The petitioner also prays for grant any other reliefs for which petitioners are found entitled in the facts and circumstances of the case."

3. Learned counsel for the petitioner submits that the petitioner is handicapped person and was appointed as Peon in

Patna High Court CWJC No.8122 of 2026(2) dt.22-06-2026 2/3 Primary Teachers Training College, Patahi, on 22.08.1986 and had been continuously working with the said Institution.

4. It has next been submitted that without any reason, the petitioner's services was terminated which was put to challenge vide C.W.J.C. No.1983 of 2002, wherein the matter was remanded to the Regional Deputy Director of Education, Muzaffarpur, (for brevity 'RDDE') for fresh consideration and the RDDE, Muzaffarpur, vide order as contained in Memo No.734 dated 09.07.2010 allowed acceptance of joining as Peon in Primary Teachers Training College, Patahi, but for unexplained reasons, the salary from May 1999 to 11.07.2010 has not been paid to this petitioner, while, the said period has been counted for the grant of ACP / MACP.

5. On the other hand, learned counsel for the State submits that the petitioner may be directed to file appropriate representation for his payment of salary for the aforementioned period, in which the petitioner was not allowed to discharge his duties.

6. Considering the fact that the petitioner is a handicapped person and for unexplained reasons, the salary has not been paid because of the order of termination passed by them which subsequently was interfered by the RDDE,

Patna High Court CWJC No.8122 of 2026(2) dt.22-06-2026 3/3 Muzaffarpur and the petitioner's joining was accepted, in such event, this Court finds it appropriate to direct the petitioner to file a detailed representation, in continuation of his earlier representation, along with all supporting materials and documents, within a period of two weeks from today and upon receipt of the same, the RDDE, Muzaffarpur, shall take a final decision within a period of six weeks thereafter. If the claim is found to be justified, necessary orders shall be passed and communicated to the petitioner, and the consequential benefits shall be extended to him within a further period of eight weeks from the date of such decision.
