====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 06-01-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Sessions Trial No.374 of 2018 arising out of Mahila P.S. Case No. 99 of 2018 registered for the offences punishable under Sections 323, 341, 376, 504 and 506 of the Indian Penal Code. By order dated 24.11.2020, a report has been called for regarding stage of trial in connection with S.T. No.374 of 2018 arising out of Mahila P.S. Case No.99 of 2018 from the court of learned Additional District Judge-1st cum Special Judge, Supaul/Incharge Successor Court. The report is enclosed at flag 'R'.

Learned Additional Sessions Judge submits that one

Patna High Court CR. MISC. No.30194 of 2020(3) dt.06-01-2021 2/2 witness has been examined and P.W.2 is to be examined and notice has been issued to the another witnesses. Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, I am not inclined to enlarge the above named petitioner on bail. Accordingly, the prayer for bail of the above named petitioner in connection with Sessions Trial No.374 of 2018 arising out of Mahila P.S. Case No.99 of 2018 pending in the court of learned Additional District Judge, 1st cum Special Judge, Supaul/Incharge Successor Court is hereby rejected. However, the trial court is directed to conclude the trial within nine months. If the trial is not concluded within nine months, the petitioner may renew his prayer for bail.

Accordingly, this applicatin is disposed of.
