2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 103(1), 238, 61, 3(5) of the BNS.
3. The case of the prosecution is that the daughter of the informant, namely, Ananya Bharti was married to Babuchandra Pawan@ Alok. It is further alleged that on 11.11.2024 at 6:30 P.M., the villagers informed him that his daughter has been killed by her in-laws.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.32693 of 2025(2) dt.22-05-2025 2/2 petitioner no. 1 and 2 are sister-in-law and petitioner no. 3 is mother-in-law. They are innocent and have falsely been implicated in connection with the present case. It is further submitted that though the allegation, as alleged in the FIR, is demand of non-fulfillment of dowry, the main thrust of allegation is against the husband of the deceased, who is already in custody. Moreover, the petitioners are languishing in judicial custody since 19.11.2024 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Daniyawan P.S. Case No. 233 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City.
