JUSTICE PURNENDU SINGH ORAL ORDER 22-11-2024 Heard Mr. Asif Kalim, learned counsel appearing on behalf of the petitioner; Mr. Abhishek Kumar along with Mr. S. Kumar Verma and Mr. Sagar Kumar, learned counsels appearing on behalf of the Informant and Mr. Ashok Kumar Singh, learned APP for the State.

2. The petitioner seeks regular bail in connection with Dumariyaghat P.S. Case No. 162 of 2023, registered for the offence punishable under Sections 323, 341, 354-B/34 of the Indian Penal Code and Section 8 of the POCSO Act.

3. Considering the nature of allegation made in the FIR against the petitioner, as well as, the statement of the victim

Patna High Court CR. MISC. No.34568 of 2024(4) dt.22-11-2024 2/2 recorded under Section 164 of the Cr.P.C., I am not inclined to enlarge the petitioner on bail.

4. It goes without saying that the learned Trial Court must expedite the trial and conclude the same expeditiously as the petitioner is under trial and any further delay will affect his right as enshrined under Article-21 of the Constitution of India.

5. Accordingly, the present bail application stands disposed of.
