The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 366(A) / 34 of the Indian Penal Code and 8 of POCSO Act.
The prosecution case is that petitioner alongwith other FIR named accused persons kidnapped the daughter of the informant with intention to marry with her. In the statement u/s 164 Cr.P.C of the victim girl, she has not named the petitioner. She further denied any sexual assault with her. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on
Patna High Court CR. MISC. No.28685 of 2019(3) dt.17-07-2019 2/2 anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Muffasil P.S. Case No. 376 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
