Petitioner seeks bail in a case registered for the offences punishable under Sections 406,409 and 504 of the Indian Penal Code.

Petitioner is in custody since 12.06.2020. Allegation is that he did not complete the work in the capacity of Contractor of the referred Nal Jal Yojana. Petitioner has produced the measurement book of completion of the work as well as scheme under which the work is being performed. Submission is that the scheme does not empower the Ward Member to interfere in the execution of the work whereas the Ward Member is complainant of this case. No complaint has come from any competent authority. Investigation of the case is

Patna High Court CR. MISC. No.33724 of 2020(6) dt.27-01-2021 2/2 already complete.

Considering the facts of this case aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Panapur Police Station Case No.30 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
