The petitioners seek bail in anticipation of their arrest in connection with Gaurichak P.S. Case No. 98 of 2020 dated 10.04.2020 instituted for the offences under Sections 304(B), 120(B) and 34 of the Indian Penal Code.

The petitioner no. 1 is the sister-in-law of the deceased who has been granted provisional bail by this Court vide order date 17.12.2020.

The petitioner no. 2 is the husband of petitioner no. 1 and is the elder brother of the husband of the deceased. The accusation against the petitioners,

Patna High Court CR. MISC. No.30343 of 2020(3) dt.09-02-2021 2/2 it has been argued are of general and omnibus nature. The husband of the deceased has surrendered to the process of law.

Considering this aspect of the matter, this Court is inclined to grant anticipatory bail to the petitioners.

Since the petitioner no. 1 has already been granted provisional bail, her provisional bail is confirmed. She shall remain on the same bail bonds.

The petitioner no. 2 is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Patnacity in connection with Gaurichak P.S. Case No. 98 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The petition stands disposed of accordingly.
