2. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 323 , 379, 494, 420, 504, 120(B) and 34 of the Indian Penal Code . 3 . As per the prosecution case , complainant solemnized marriage with the petitioner in 2005 and started living in her sasural where petitioner and other co-accused persons subject her to cruelty and assault and also ousted her from her matrimonial house for the demand of dowry .
4. It is submitted on behalf of the petitioner that he has falsely been implicated in this case . It is further submitted
Patna High Court CR. MISC. No.34142 of 2024(3) dt.10-05-2024 2/2 that informant herself leave her matrimonial house with her own will. Petitioner is ready to keep his wife (victim) with full honour and dignity. Allegation is general and omnibus. Chargesheet has already been submitted and he is in custody since 10.03.2024 .
5 . Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed.
6. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addditional Chief Judicial Magistrate - 2, Kaimur at Bhabua in connection with Bhabhua Complaint Case No. 383 of 2021 .
